When you order from us, you agree to our general terms and conditions.

ARTICLE 1 - DEFINITIONS

The terms written in capital letters in the general terms and conditions have the following meaning:

  • Supplier: Sole proprietorship Semse, established in Doetinchem and registered with the Chamber of Commerce under file number 89526767.

  • Customer: The natural or legal person with whom the supplier has concluded an agreement.

  • Agreement: The arrangement between supplier and customer for the delivery of one or more products from the supplier's assortment by the supplier to the customer.

ARTICLE 2 - GENERAL

2.1 Introduction 
The purpose of these general terms and conditions is to define the obligations and responsibilities of supplier and customer when entering into an agreement by purchasing one or more products from Supplier.

ARTICLE 3 - APPLICABILITY & APPLICABLE LAW

3.1 Applicability
These general terms and conditions apply to every agreement between the supplier and customer, unless both parties have expressly agreed otherwise in writing. 
3.2 Applicable Law 
Dutch law exclusively applies to every agreement and the related general terms and conditions.

ARTICLE 4 - AGREEMENT

4.1 Formation of Agreement
An agreement is concluded at the moment of ordering and payment of one or more products on the supplier's website by the customer, including acceptance of these general terms and conditions.

ARTICLE 5 - ORDER

5.1 Ordering Methods 
The supplier offers the possibility to order products from its assortment through the following channels:

  • Webshop By using the online ordering process on www.tattforaweek.nl 
  • Mail By submitting a request via e-mail, sent to info@tattforaweek.nl
  • Oral By entering into an oral agreement with sole proprietorship Semse.

5.2 Obligations of Supplier

  • The supplier provides the customer with all necessary information about the order status, payments, the products to be delivered, and how they should be used during the ordering process.
  • The supplier guarantees the privacy of all visitors to the webshop, regardless of whether the visitor places an order or not. All personal information left by visitors and/or customers is treated confidentially. The supplier does not share personal data with third parties under any circumstances, unless necessary/if this party is involved in the ordering, payment, and/or shipping process.
  • In addition to fulfilling orders, personal data will be used for marketing purposes and maintaining the customer relationship with the customer.

5.3 Obligations of the customer

  • The customer must read the supplier's general terms and conditions during the ordering process and agree to them before the order can be completed.
  • The customer must be at least 18 years old to make a purchase on tattforaweek.nl. The supplier does not sell to minors (<18 years) and is not liable for age fraud. 

ARTICLE 6 - PRICES & PAYMENT

6.1 Prices

  • All prices listed in the webshop or other communications of the supplier include 21% VAT and exclude shipping costs.
  • The supplier may change prices, offers, and (price) conditions at any time in relation to the customer, as long as no agreement has yet been made.
  • The supplier cannot be held to prices or offers if the customer could reasonably have understood that the price or offer contained an obvious mistake or error.
  • The supplier charges €2.95 shipping costs for each order within the Netherlands in case of a standard delivery and free shipping from €20,00 unless expressly agreed otherwise.
  • The amount of the shipping costs, as mentioned above, is fixed and not dependent on the size of the order.

6.2 Payment

  • The supplier offers the following payment methods: BePayment via Ideal and via Credit Card (Visa and MasterCard).
  • The supplier does everything possible to provide a secure environment in which the customer can make the payment, but is not responsible for malfunctions and/or failures of third parties.
  • The supplier guarantees a safe and discreet handling of (personal) data of the customer and does not share it with third parties, unless the supplier is legally obliged to do so.

ARTICLE 7 - SHIPPING

  • The supplier guarantees shipment of the ordered products to the customer within 1 to 3 working days in case of a standard delivery..

  • The supplier is not liable for delivery delays caused by third parties, such as the delivery party.

  • The supplier is not liable for any damage resulting from exceeding the indicated delivery times.

  • The supplier always strives for completeness of the order but cannot guarantee it. If the customer reports the absence of one or more products in the delivery within 7 days, the order will be supplemented, provided an inspection does not show that the order was complete.

  • In case the indicated delivery time cannot be met due to the supplier's fault, the customer will be informed within 3 working days after the order. A suitable solution will be sought in consultation.

  • The supplier is in no case responsible for incorrect delivery caused by third parties and/or the customer themselves. The customer is always responsible for correctly entering the address details.

ARTICLE 8 - RETURNS

    • The supplier does everything possible to ensure delivery is carried out correctly, with all products delivered in the proper condition. The customer is requested to inspect the delivered products immediately upon receipt for completeness and proper condition. If a problem occurs, the customer must report it as soon as possible, after which both parties will seek a suitable solution in consultation.

    • As far as the order concerns personalized products, you have no reflection period, right of withdrawal, right of return, or right of dissolution (art. 6:230p sub f under 1° BW).

ARTICLE 9 - LIABILITY

  • The supplier is in no case liable for any damage in any form, to persons or goods, resulting from the use of any of the supplier's products by the customer.

  • The customer must always take into account the user instructions when using the supplier's products.

  • Any liability of the supplier, its personnel, and the supplier's products for any damage, of any kind, direct or indirect, is excluded. 

ARTICLE 10 - FORCE MAJEURE

  • The supplier is not obliged to fulfill any obligation towards the customer if hindered due to a circumstance not attributable to fault, and which neither by law, a legal act, nor prevailing opinions in commerce is the supplier's responsibility. In these general terms and conditions, force majeure is understood, in addition to what is understood in law and jurisprudence, as all external causes, foreseen or unforeseen, over which the supplier has no control, but which prevent the supplier from fulfilling its obligations. The supplier also has the right to invoke force majeure if the circumstance preventing (further) performance of the agreement occurs after the customer should have fulfilled their obligation.
